Terms of Service

1. Acceptance of these Terms
By creating an account or otherwise using ChambaPay (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2. Description of the Service
ChambaPay is a web application that lets contractors and service businesses build price catalogs, generate estimates from measurements and prices, convert estimates into invoices and receipts, brand PDF documents, track income on a dashboard, and accept online payments from their own clients via Stripe.
3. Accounts
You must provide accurate information when creating an account and keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at support@chambapay.app if you suspect unauthorized use of your account.
4. Plans, Billing, and Cancellation
- Free plan: limited to a set number of documents per calendar month, at no cost, for as long as you like.
- Premium plan: a paid monthly subscription (currently $4.99/month) billed automatically through Stripe until cancelled. Pricing may change with advance notice.
- Cancellation: you may cancel your Premium subscription at any time from Company Settings; access continues until the end of the current billing period. We do not provide prorated refunds for partial billing periods except where required by law.
- Failed payments: if a renewal payment fails, we may downgrade your account to the Free plan and its document limits.
5. Your Data and Content
You retain ownership of the data you enter into ChambaPay, including your company information and the client records, estimates, invoices, and receipts you create ("Your Content"). You grant ChambaPay a limited license to host, process, and display Your Content solely to operate and improve the Service. You are solely responsible for the accuracy of Your Content and for having the right to store any client personal information you enter.
6. Payments to Your Clients (Stripe)
ChambaPay integrates with Stripe to let your clients pay invoices online. ChambaPay is not a party to the underlying transaction between you and your client and does not take custody of these funds — they are handled directly by Stripe under its own terms and privacy policy. You are responsible for your relationship with your clients, including any disputes, refunds, or chargebacks.
7. Acceptable Use
You agree not to: use the Service for unlawful purposes; upload malicious code; attempt to gain unauthorized access to other accounts or to the Service's infrastructure; resell or white-label the Service without written permission; or use the Service to send unsolicited communications.
8. Termination
You may stop using the Service and delete your account at any time from Company Settings. We may suspend or terminate accounts that violate these Terms, with notice where reasonably possible.
9. Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. ChambaPay does not guarantee uninterrupted or error-free operation.
10. Limitation of Liability
To the maximum extent permitted by law, ChambaPay and its operators will not be liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
12. Governing Law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles, unless otherwise required by applicable local law.

1. Aceptación de estos Términos
Al crear una cuenta o usar ChambaPay de cualquier otra forma (el "Servicio"), aceptas quedar sujeto a estos Términos de Servicio ("Términos"). Si usas el Servicio en representación de un negocio, declaras que tienes la autoridad para comprometer a ese negocio con estos Términos.
2. Descripción del Servicio
ChambaPay es una aplicación web que permite a contratistas y negocios de servicios armar catálogos de precios, generar estimados a partir de medidas y precios, convertir estimados en facturas y recibos, personalizar documentos PDF con su marca, dar seguimiento a sus ingresos en un panel, y aceptar pagos en línea de sus propios clientes a través de Stripe.
3. Cuentas
Debes proporcionar información precisa al crear una cuenta y mantener tus credenciales de acceso en confidencialidad. Eres responsable de toda actividad que ocurra bajo tu cuenta. Notifícanos de inmediato a support@chambapay.app si sospechas de un uso no autorizado de tu cuenta.
4. Planes, Facturación y Cancelación
- Plan Gratis: limitado a una cantidad fija de documentos por mes calendario, sin costo, por el tiempo que quieras.
- Plan Premium: una suscripción mensual paga (actualmente $4.99/mes) cobrada automáticamente a través de Stripe hasta que la canceles. El precio puede cambiar con aviso previo.
- Cancelación: puedes cancelar tu suscripción Premium en cualquier momento desde Configuración de Empresa; el acceso continúa hasta el final del período de facturación actual. No ofrecemos reembolsos prorrateados por períodos parciales, salvo que la ley lo exija.
- Pagos fallidos: si un pago de renovación falla, podemos bajar tu cuenta al Plan Gratis y sus límites de documentos.
5. Tus Datos y Contenido
Conservas la propiedad de los datos que ingresas en ChambaPay, incluyendo la información de tu empresa y los registros de clientes, estimados, facturas y recibos que creas ("Tu Contenido"). Le otorgas a ChambaPay una licencia limitada para alojar, procesar y mostrar Tu Contenido únicamente para operar y mejorar el Servicio. Eres el único responsable de la precisión de Tu Contenido y de tener el derecho de almacenar cualquier información personal de clientes que ingreses.
6. Pagos a tus Clientes (Stripe)
ChambaPay se integra con Stripe para que tus clientes puedan pagar facturas en línea. ChambaPay no es parte de la transacción entre tú y tu cliente y no tiene custodia de esos fondos — son manejados directamente por Stripe bajo sus propios términos y política de privacidad. Eres responsable de tu relación con tus clientes, incluyendo cualquier disputa, reembolso o contracargo.
7. Uso Aceptable
Aceptas no: usar el Servicio para fines ilegales; subir código malicioso; intentar obtener acceso no autorizado a otras cuentas o a la infraestructura del Servicio; revender o usar el Servicio bajo otra marca sin permiso por escrito; o usar el Servicio para enviar comunicaciones no solicitadas.
8. Terminación
Puedes dejar de usar el Servicio y eliminar tu cuenta en cualquier momento desde Configuración de Empresa. Podemos suspender o terminar cuentas que violen estos Términos, avisando cuando sea razonablemente posible.
9. Exención de Garantías
El Servicio se ofrece "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas, incluyendo idoneidad para un propósito particular. ChambaPay no garantiza un funcionamiento ininterrumpido o libre de errores.
10. Limitación de Responsabilidad
En la máxima medida permitida por la ley, ChambaPay y sus operadores no serán responsables por daños indirectos, incidentales, especiales o consecuentes, ni por ganancias o datos perdidos, derivados de tu uso del Servicio. Nuestra responsabilidad total por cualquier reclamo relacionado con el Servicio no excederá el monto que nos pagaste en los doce meses previos al reclamo.
11. Cambios a estos Términos
Podemos actualizar estos Términos de vez en cuando. Los cambios importantes se publicarán en esta página con una fecha de "Última actualización". El uso continuo del Servicio después de que los cambios entren en vigor constituye la aceptación de los Términos revisados.
12. Ley Aplicable
Estos Términos se rigen por las leyes del Estado de Florida, EE. UU., sin considerar principios de conflicto de leyes, salvo que la ley local aplicable exija lo contrario.
